1. Private New Jersey mediation is typically a voluntary process. Both parties are willing participants who agree to be engaged in the process towards a potential resolution. At times, agreeing to mediation is the first step towards potential resolution. 

​

2. Mediation is Confidential. Every New Jersey mediation, whether private or court–mandated, is confidential. This ensures that the settlement discussions and negotiated positions revealed by each party never reach the judge, courtroom, or court papers. Both parties are therefore free to openly offer reasonable settlement terms without the concern that a judge might learn about their "over-generosity" or "under-generosity" should a settlement not occur in mediation.

 

3. Mediation is Neutral meaning in both the private mediation process and in court-mandated New Jersey mediation, the professional mediator's role is to remain impartial with no vested interest in either party's position.
 

4. Mediation is Non-binding. No agreement reached during the course of the mediation session is initially subject to enforcement until the final settlement contract is signed by both parties.

 

5. Mediation is Collaborative. The mediator's objective is to assist both parties in achieving an amicalbe resolution that adheres to the needs of the parties as well as their family. It is important to know that when couples settle their own conflicts during mediation, it tends to reduce the tension between the couples post divorce. This helps preserve co-parenting relationships.
